Permissions Request Form

The California Historical Society supports scholarship and research by providing reproductions of materials for private study and general use. CHS encourages you to use materials from our collections that are in the public domain, and to make fair use of copyrighted materials as defined by copyright law. Requests are fulfilled to the extent allowed by the format and physical condition of the material, as well as any applicable restrictions, including copyright regulations, privacy rights, donor-imposed regulations, or other rights related issues. We encourage you to visit The North Baker Research Library to view collections and select specific images for reproduction. Many of our images are also available for viewing on CHS’s Digital Library.

To place a request for permission to reproduce or publish an image for CHS holds copyright, please review the Fee Schedule, FAQ, and other information available on our Rights & Reproductions Page, then complete the form below:


    Personal - Used only in a private home or office. They will not be displayed in a sales area or reproduced for any other purpose. If I decide to reproduce these images and any way, I agree to cite CHS as the source and use with the credit lines described above.Non-Profit - Use of these image(s) will be published, displayed, or broadcast by a California 501(c)(3), organization or a governmental agency. Any profit from the publication, display, or broadcast will go into the account of the non-profit organization and not to an individual or corporation. I understand that images in which CHS claims no rights may be reproduced without written permission from CHS or a use fee. If I decide to reproduce these images for use in a publication, exhibit, audio/visual media, or website, etc., I agree to cite CHS as the source and use with the credit lines described above.Commercial Use in any manner. Use of these images in a publication, advertisement, film, video, DVD, CD-ROM, website, etc. The image(s) will be published, displayed, or broadcast in a commercial or media environment for profit. This includes commercial websites representing a person or corporation who sell goods or services. Public Display: Displayed image(s) in a public environment, such as a restaurant, sales office, reception area, or hotel/lobby room.

    Materials Requested

    Please list the materials you are requesting permission to reproduce. Please include the following information if available: Title, Call Number, Box number, Folder number, Identifier, Digital ID.


    Copyright and Use

    Permission is granted for one-time, non-exclusive, world-wide use of licensed images in all languages, in any media, for the life of the title, as well as use in advertising and promotional materials. This does not imply permission for any derivative products or productions. Reuse of licensed images must be requested and granted in writing by the California Historical Society (CHS). Permissions are not transferrable. Resale of licensed images in any form is prohibited.

    The user is responsible for securing any licenses from copyright owners, other than CHS, as may be necessary for the purposes of making or.exploiting the licensed image. The user will not use or reproduce the licensed images in any way that may infringe the copyrights, moral rights, rights of publicity, or other rights of any third parties. If the user wishes to use names or likenesses of recognizable individuals within the licensed image for any purposes, the user will obtain at its expense any additional clearances, waivers, and permissions and will indemnify and hold CHS harmless from any and all losses and liabilities arising from such uses.

    All licensed images must be credited as "Courtesy, California Historical Society." The official credit line, as specified by CHS, must appear in the publication or program credits or accompanying guide or manual, if not next to the adjacent frame, in television, films, etc. When provided, the item's title, collection name, call number, and identifier must be included in the credit line. References to CHS in any manner in connection with the work, outside of the copyright/credit line, are prohibited except as expressly agreed to in writing by CHS.

    Upon request, publisher will provide CHS with at least one complimentary copy of the publication in which the reproduction appears.

    Attribution

    The name of the California Historical Society must not be used in any manner that incorrectly implies any sponsorship or endorsement by CHS. When you use reproductions from CHS's collections, you must acknowledge CHS as the source of the material in the following manner.

    Any breach of conditions may result in revocation of permission. CHS reserves the right to seek remedies and/or damages.
