Film Footage Request Form

The California Historical Society supports scholarship and research by providing reproductions of materials for private study and general use. CHS encourages you to use materials from our collections that are in the public domain, and to make fair use of copyrighted materials as defined by copyright law. Requests are fulfilled to the extent allowed by the format and physical condition of the material, as well as any applicable restrictions, including copyright regulations, privacy rights, donor-imposed regulations, or other rights related issues. We encourage you to visit The North Baker Research Library to view collections and select specific images for reproduction. Many of our images are also available for viewing on CHS’s Digital Library.

    Recordings Requested

    Please list the recordings you are requesting permission to reproduce. Please include the following information: Title, Call Number, Identifier, Duration of footage requested, Start and End times.

    Approved Film Footage Requests will be fulfilled and invoiced by A/V Geeks.

    Conditions of Use:

    Permission is granted for one-time, non-exclusive, world-wide use of licensed footage in all languages, in any media, for the life of the title, as well as use in advertising and promotional materials. This does not imply permission for any derivative products or productions. Reuse of licensed footage must be requested and granted in writing by the California Historical Society (CHS). Permissions are not transferable. Resale of licensed footage in any form is prohibited.

    The user is responsible for securing any licenses from copyright owners, other than CHS, as may be necessary for the purposes of making or exploiting the licensed footage. The user will not use or reproduce the licensed footage in any way that may infringe the copyrights, moral rights, rights of publicity, or other rights of any third parties. If the user wishes to use names or likenesses of recognizable individuals within the licensed footage for any purposes, the user will obtain at its expense any additional clearances, waivers, and permissions, including any music rights, that may be needed in connection with these particular uses of the footage and will indemnify and hold CHS and A/V Geeks harmless from any and all losses and liabilities arising from such uses.

    All licensed footage must be credited as *Courtesy, California Historical Society: The official credit line, as specified by CHS, must appear in the program credits or accompanying guide or manual, if not next to the adjacent frame, in television, films, etc. When provided, the item's title, collection name, call number, and identifier must be included in the credit line. References to CHS in any manner in connection with the work, outside of the copyright/credit line, are prohibited except as expressly agreed to in writing by CHS.

    Any breach of conditions may result in revocation of permission. CHS and A/V Geeks reserve the right to seek remedies and/or damages.
